Terms of Service

These Terms are an agreement between you and Page Platforms (Pty) Ltd (registration number 2023/886351/07), trading as Keni ("Keni", "we", "us"). They apply to keni.co.za, the Keni dashboard at admin.keni.co.za, and the online stores we host for merchants (together, the "Service").
By creating an account or using the Service you agree to these Terms, our Privacy Policy, our Acceptable Use Policy and our Refund Policy. If you use Keni for a business, you confirm that you are authorised to accept these Terms on its behalf.
1. What Keni is
Keni is software for South African businesses. It includes a website and online store builder, an image and video editor, an AI assistant, a customer chatbot for your website, templates, order and booking management, and hosting for your store.
Keni is a software provider, not a payment provider. When a customer buys from a store built on Keni, the sale is between that customer and the merchant who owns the store. Keni is not a party to that sale. The only things you buy from Keni are your subscription, AI credit top-ups (see section 5) and, if you choose, a domain (see section 6).
2. Your account
- You must be at least 18 years old to create an account.
- You must give us accurate, current and complete information when you sign up, including your name, contact details and business details, and keep it up to date.
- You are responsible for keeping your login details secure and for everything done through your account. Tell us immediately at team@keni.co.za if you suspect unauthorised access.
- We may ask you for more information to confirm your identity or your business, and we may decline or suspend an account if we cannot.
3. How payments work on your store
Your customers pay you through your own payment provider account, such as your own Paystack or Payfast account, which you connect to your Keni store.
- Money goes directly to you. Customer payments are processed by your payment provider and settled into your own account. Keni does not receive, hold or pay out your customers' money.
- Your provider's rules apply. You must complete your payment provider's identity and business verification and follow its terms. If your provider suspends or restricts your account, your store may not be able to take payments, and Keni cannot override that.
- Your payment keys. The API keys you give us to connect your payment account are stored encrypted and used only to create and verify payments for your store.
4. Your responsibilities as a merchant
You are the seller of record for everything sold through your store. You must:
- Describe your products and services accurately, and show the full price, including any delivery costs, before your customer pays.
- Show your business name, contact details and your own refund, returns and cancellation policy on your store, as required by the Consumer Protection Act and the Electronic Communications and Transactions Act.
- Fulfil the orders and bookings you accept.
- Handle your customers' refunds, complaints, disputes and chargebacks. Chargebacks are raised against your payment provider account and must be answered through your provider. Keni gives you order records to support your response.
- Collect and pay any taxes due on your sales, including VAT if you are registered.
- Handle your customers' personal information lawfully under the Protection of Personal Information Act (POPIA). See section 9.
- Follow our Acceptable Use Policy, which lists what may not be sold or done on Keni.
5. Subscription, AI credits and billing
- Price. Keni is a monthly subscription at the price shown on our pricing page when you subscribe. Prices are in South African Rand.
- Billing. You are billed monthly in advance through Paystack. By subscribing, you authorise us to charge your chosen card each month until you cancel. Keni never sees or stores your full card number.
- Included AI credits. AI features use credits. Each billing period, your subscription includes a number of credits. Included credits expire at the end of that billing period and do not carry over.
- Top-up credits. If you run out, you can buy more credits. Pack sizes and prices are shown before you pay, and top-ups are paid to Keni through Paystack. Included credits are used first. Top-up credits stay valid for 3 years from the date you buy them, as long as your account is open.
- Credits have no cash value. They can only be used for AI features on your Keni account, and cannot be transferred or exchanged for money. If you run out, AI features pause until you top up or your next billing period starts. The rest of your store keeps working.
- Failed payments. If a payment fails, we will notify you and try again. If it remains unpaid, we may suspend your account and take your store offline until the balance is paid.
- Cancellation. You can cancel at any time from your billing settings. You keep access until the end of the period you have paid for, and you will not be charged again.
- Refunds. Refunds are covered by our Refund Policy.
- Price changes. We will give you at least 30 days' notice by email before a price change. A new price applies from your next billing period after the notice ends. If you do not accept it, you can cancel before then.
6. Domains
You can connect a domain you already own to your store, or buy one through Keni.
- Keni is a reseller. Domains bought through Keni are registered through our registrar partner, domains.co.za, with you as the registrant. They are subject to the rules of the relevant registry (for .co.za domains, the ZA Central Registry).
- Payment. Domain fees are separate from your subscription, shown to you before you pay, and paid to Keni through Paystack.
- Price and term. Domains bought through Keni are registered for one year at a time. Registration and each renewal cost the price shown in your dashboard (currently R100 per year).
- Renewal. Renewal opens 30 days before a domain expires. If automatic renewal is on, we charge the card saved on your Keni account at that point and, if the charge fails, try again every few days. You can also pay for the renewal yourself from the Domains page at any time in that period. We email you when a renewal is due, if a charge fails, and a final reminder before the deadline.
- Renewal deadline. A renewal must be paid no later than 7 days before the domain's expiry date. If it has not been paid by then, we delete the domain at the registry and remove it from your store. Your store stays online at its Keni address.
- No redemption or recovery. Keni does not offer domain redemption, restoration or recovery. Once a domain has been deleted for non-payment we cannot get it back for you, and it may become available for anyone to register.
- Refunds. Domain fees are covered by our Refund Policy.
7. AI features
- Review what AI produces. AI-generated text, images, videos and answers can be wrong or unsuitable. Review them before you publish or rely on them.
- You are responsible for your chatbot. The customer chatbot answers your customers' questions using the product and store information you provide. It can only read that information: it cannot place orders, take payments, or change anything in your store. Keep your information accurate, because the chatbot's answers are only as good as what you give it.
- Use it lawfully. You may not use AI features to create content that breaks our Acceptable Use Policy, infringes someone else's rights, or depicts a real person without their permission.
8. Your content
You keep ownership of everything you add to Keni: your products, images, videos, text and data. You give us a licence to host, store, copy, display and process that content only as needed to provide the Service to you, for example to show your store to visitors or to generate an AI design you asked for.
You confirm that you have the rights to the content you upload, and that it does not infringe anyone else's rights.
9. Your customers' personal information
Under POPIA, you are the responsible party for your customers' personal information, and Keni processes it on your behalf as your operator. We only process it to run your store and the features you use, keep it secure, and do not use it for our own marketing. You must have a lawful reason to collect it and must tell your customers how you use it. See our Privacy Policy for details.
10. Shopping on a store built with Keni
If you are buying from a store built with Keni, you are buying from the merchant who runs that store, not from Keni. Questions about an order, delivery, refund or return should go to the merchant, using the contact details on their store. Your payment is processed by the merchant's payment provider.
If you believe a store is fraudulent or breaks our Acceptable Use Policy, report it to team@keni.co.za and we will investigate.
11. Our intellectual property
The Keni software, templates, designs, interfaces and code belong to Page Platforms (Pty) Ltd and are protected by copyright and other intellectual property laws. You may use templates as part of your Keni store, but you may not copy, resell or redistribute the Service or its templates outside Keni.
12. Third-party services
Parts of the Service rely on other providers, including payment providers, domain registrars, cloud hosting and AI providers. Your use of a third-party service you connect, such as your Paystack or Payfast account, is also governed by that provider's terms. We are not responsible for a third party suspending your account or changing its service.
13. Availability and changes to the Service
We work to keep Keni available and reliable, but we cannot promise it will always be uninterrupted or error-free. We may need to carry out maintenance, and we may change or improve features. If we remove a feature that is central to what you pay for, we will tell you in advance.
14. Suspension and termination
We may suspend or close your account, or take your store offline, if you break these Terms or our Acceptable Use Policy, do not pay, act fraudulently, put customers or the platform at risk, or if the law requires it. Where appropriate, we will tell you why and give you a chance to respond.
You can close your account at any time. After your account closes, we delete or anonymise your store data within a reasonable period, except records we must keep by law, such as financial records.
15. Limitation of liability
To the extent the law allows, Keni is not liable for indirect or consequential loss, including lost profits, lost sales, lost data or reputational harm, arising from:
- your use of, or inability to use, the Service;
- your products, your store, or your dealings with your customers;
- third-party services, including your payment provider;
- errors in AI-generated content; or
- unauthorised access to your account that was not caused by our negligence.
Our total liability to you for any claim is limited to the subscription fees you paid Keni in the 12 months before the claim arose. Nothing in these Terms limits any right you have under the Consumer Protection Act or other law that cannot lawfully be limited.
16. Indemnity
You agree to indemnify Keni against claims by third parties, including your customers and payment provider, arising from your products or services, your store content, or your breach of these Terms or the law.
17. Disputes and governing law
If you have a complaint about Keni, contact us first at team@keni.co.za. We will acknowledge it within 2 business days and try to resolve it within 20 business days.
These Terms are governed by the laws of the Republic of South Africa. Any dispute we cannot resolve together may be referred to the courts in Cape Town, Western Cape, and you and Keni consent to the jurisdiction of the Magistrates' Court for claims within its limits.
18. Changes to these Terms
We may update these Terms. If a change materially affects you, we will email you at least 30 days before it takes effect. The "last updated" date above shows when the Terms last changed.
